TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legally binding agreement made between you and PublicRise LLC ("we," "us," or "our"), concerning your access to and use of the publicrise.org website and any related services (collectively, the "Services").

PublicRise is an online career guidance platform for local government job seekers and promotional candidates, offering free resources, paid membership content, and one-on-one mentoring services.

By accessing or using the Services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.


1. USER REPRESENTATIONS


By using the Services, you represent and warrant that:
  • You are at least 18 years of age
  • You will only use the Services for personal, non-commercial purposes
  • All registration and account information you provide is true, accurate, current, and complete
  • You will maintain the accuracy of such information and update it as necessary
  • You have the legal capacity to comply with these Terms

2. PROHIBITED ACTIVITIES


You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to:
  • Use the Services to advertise or offer to sell goods and services
  • Sell or otherwise transfer your account or profile
  • Share, redistribute, or republish PublicRise content, templates, guides, or downloads outside of your individual membership without written permission
  • Use the AI-powered tools to generate content for any purpose other than your own personal government job application materials
  • Engage in unauthorized framing of or linking to the Services
  • Attempt to bypass any measures designed to prevent or restrict access to the Services
  • Use any information obtained from the Services to harass, abuse, or harm another person
  • Use the Services in a manner inconsistent with applicable laws or regulations

3. SUBSCRIPTIONS AND PAYMENT


3.1 Membership Tiers

PublicRise offers free and paid membership tiers, as well as one-on-one mentoring sessions, with pricing and features described on our website.

3.2 Payment

We accept payment via Visa, Mastercard, American Express, and Discover, processed securely through our third-party payment processor, Stripe.

3.3 Cancellation

Users may cancel their subscription at any time by emailing hello@publicrise.org with the subject line "Cancel Subscription." Cancellation will take effect at the end of the current billing period, and access to paid features will continue until that date. We will process all cancellation requests within 2 business days.

3.4 Refunds

Mentoring session refunds are available if canceled at least 24 hours before the scheduled session. Sessions canceled with less than 24 hours notice, or no-shows, are non-refundable.

Membership subscriptions can be canceled at any time; access continues until the end of the current billing period with no partial refunds for unused time.

4. NO REVIEWS OR PUBLIC RATINGS


The Services do not currently include a public review or rating feature. Any testimonials displayed on our website are selected and published at our discretion.

5. INTELLECTUAL PROPERTY RIGHTS


Unless otherwise indicated, the Services and all content and materials therein, including but not limited to text, graphics, logos, guides, templates, and downloadable resources (collectively, the "Content"), are owned or licensed by PublicRise LLC and are protected by copyright and other intellectual property laws.

The Content is provided to you for your personal, non-commercial use only. You may not copy, reproduce, distribute, or create derivative works from the Content without our express written permission.

6. TERM AND TERMINATION


These Terms remain in full force and effect while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason, including breach of any representation, warranty, or covenant contained in these Terms, or of any applicable law or regulation.

7. LIMITATION OF LIABILITY


To the fullest extent permitted by applicable law, in no event will PublicRise LLC or its founder be liable to you for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Services.

Our total liability to you for any claim arising from or related to these Terms or the Services will not exceed the lesser of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) $500 USD.

Any claim must be brought within one (1) year after the event giving rise to such claim occurred. Otherwise, such claim is permanently barred.

8. DISCLAIMER


The information provided by PublicRise LLC is for educational and informational purposes only. PublicRise does not guarantee employment, job placement, promotion, or any specific career outcome. Results will vary based on individual qualifications, effort, experience, and hiring conditions outside of PublicRise's control. PublicRise content is based on the founder's personal professional experience in local government and should not be construed as legal, HR, or career counseling advice.

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK.

9. DISPUTE RESOLUTION


9.1 Informal Negotiations

To expedite resolution and reduce the cost of any dispute, you and PublicRise LLC agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration.

9.2 Binding Arbitration

If informal negotiations do not resolve the dispute, you and PublicRise LLC agree to resolve any dispute through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. This arbitration agreement applies only to businesses or users in the United States, or where a claim is brought against PublicRise LLC within the United States. Arbitration is mandatory.

Arbitration will take place in the State of California. We agree to pay arbitration fees if they are deemed excessive by the arbitrator.

9.3 Litigation

If a dispute proceeds in court rather than arbitration for any reason, such litigation will take place in the State of California, and you agree to submit to the personal jurisdiction of the courts located in California.

10. GOVERNING LAW


These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

11. CORRECTIONS


There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.

12. MODIFICATIONS AND INTERRUPTIONS


We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time.

13. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?


As part of our Services, we offer products, features, or tools powered by artificial intelligence, including a résumé and cover letter tailoring tool. We provide these AI-powered products through third-party service providers, including Anthropic. Your use of any AI-powered features within the Services is subject to our Privacy Notice and the applicable terms of our AI Service Providers. You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider, or in any way other than for your own personal government job application materials.
